1. General

1.1 What is personal data

​

Personal data is information that reveals or can reveal the identity of the user. We adhere to the principle of data avoidance. The collection of personal data is avoided as far as possible.

1.2 Handling of personal data

​

Personal data is used exclusively to establish the contract, design the content, implement or process the contractual relationship (Art. 6 I S. 1 b GDPR).

In addition, personal data will only be processed if we have received your consent (Art. 6 I S. 1 a DSGVO) or if it is data whose processing is necessary for our legitimate interests and if the consideration shows that no conflict with overriding interests, fundamental rights or fundamental freedoms on your part (Art. 6 I S. 1 f GDPR).

We can use contract processors to process your personal data, but we will generally not pass on the personal data to third parties.

The data will only be passed on to the shipping company commissioned with the delivery for the purpose of fulfilling the contract, insofar as this is necessary for the delivery of ordered goods. In order to process payments, the payment data required for this will be passed on to the bank commissioned with the payment and, if applicable, the commissioned and selected payment service provider.

The processing of your personal data takes place exclusively within the EU, unless otherwise stated below.

1.2.1 Registration for events

​

When registering for one of our events, you send us your personal data using a form. This form is a written agreement (contract) by which you declare your intention to use our service. We store your contact details (name, e-mail, telephone number, address) in digital and printed form for an indefinite period of time (but at least 7 years as part of the obligation to keep records with the tax office).

As part of an event registration, we also process information about your children if they are participants in the event, or health data from you and/or your children (physical limitations, allergies and intolerances). The processing is necessary to protect vital interests. This data is stored for up to 6 months after the end of the event.
 

1.2.2 Joint Controllers

If Mag. Eva Rümmele does not act as the organizer herself, she only provides services such as the website, social media appearances or customer communication (e.g. administration of registrations, e-mails, SMS) for the other organizers to use. The organizers are explicitly listed in the information about an event.

All data transmitted in relation to a specific event will be transmitted to the respective organizer and processed in accordance with the data protection declaration of the organizer.

 

1.3 Usage Data

When visiting the website, general technical information is collected. These are the IP address used, time, duration of the visit, browser type and, if applicable, the originating site. For technical reasons, this usage data is registered in a log file and can be used and stored for the purpose of statistical analysis of this website. This usage data is not linked to your other personal data.

1.4 Registration Data

​

Registration is required for full use of the functions of our website. The registration data is collected through your corresponding entries and used for the specifically stated purpose in accordance with your consent (Art. 6 I S. 1 a DSGVO).

1.5 Newsletters

​

You have the option of subscribing to our newsletter via our website. For this we need your e-mail address and your declaration that you agree to receive the newsletter. You can unsubscribe from the newsletter at any time. To do this, use the link provided in the footer of each e-mail.

1.6 Duration of storage

After the end of the purpose for which the data was collected, we only store your personal data for as long as this is required by law (in particular tax law) regulations.

You can request information from us as to whether we process your personal data and, if this is the case, you have a right to information about this personal data and to the further information specified in Art. 15 DSGVO.

2.2 Right to Rectification

​

You have the right to correct incorrect personal data concerning you and, in accordance with Art. 16 GDPR, you can request the completion of incomplete personal data.

2.3 Right to erasure

​

You have the right to request that the personal data concerning you be deleted immediately. We are obliged to delete them immediately, especially if one of the following reasons applies:

  • Your personal data are no longer necessary for the purposes for which they were collected or otherwise processed.

  • You revoke your consent on which the processing of your data was based and there is no other legal basis for the processing.

  • Your data has been unlawfully processed.

The right to erasure does not exist if your personal data is required to assert, exercise or defend our legal claims.

2.4 Right to restriction of processing

You have the right to request that we restrict the processing of your personal data if

​

  • you dispute the accuracy of the data and we therefore check the accuracy,

  • the processing is unlawful and you reject the deletion and instead request the restriction of use

  • we no longer need the data, but you need them to assert, exercise or defend legal claims,

  • You have objected to the processing of your data and it is not yet clear whether our legitimate reasons outweigh your reasons.

2.5 Right to data portability

You have the right to receive the personal data that you have provided to us in a structured, common and machine-readable format and you have the right to transmit this data to another person responsible without hindrance from us, provided that the processing is based on consent or a contract and the processing is carried out by us using automated procedures.

2.6 Right of Withdrawal

If the processing of your personal data is based on consent, you have the right to revoke this consent at any time.

2.7 General and Right to Complain

​

The exercise of your above rights is basically free of charge for you. In the event of complaints, you have the right to contact the supervisory authority responsible for us, the state data protection officer.

All data on our website is protected against loss, destruction, access, modification and distribution by technical and organizational measures.

To operate the website, we use cookies or server-side sessions in which data can be stored. We ensure that no personal data is taken from sessions or by cookies without your express consent and cookies are only used if this is technically necessary for the website (e.g. spam protection for the contact form, shopping cart function) and thus the consideration shows that no overriding interests on your part (Art. 6 I S. 1 f DSGVO) or you have given your express consent.

With your express consent, we use cookies to personalize content and ads, to provide social media features, and to analyze traffic to our website. With your consent, we may share information about your use of our website with our social media, advertising and analytics partners. Our partners may be able to combine this information with other data that the partners already have about you.

4. Comments

If you use the comment function on our website, the time of creation, your chosen pseudonym and temporarily your IP address will be stored in addition to these comments. This is done so that we can protect our rights in the event of illegal content.

These social media platforms may process personal data outside the EU; in this respect, we refer to the above data protection declarations of the social media platforms.

The respective social media platforms may be able to use your usage behavior and the resulting interests to create usage profiles on your part and store cookies on your computer in which your usage behavior is saved. If you have an account on the respective social media platform and are logged in, your usage behavior can even be stored independently of the device. Your usage profile can be used, for example, to place advertisements that presumably correspond to your interests.

We process the personal data exclusively to communicate with you via the social media platform you have selected and to optimize our online presence and ensure that no interests on your part are affected which outweigh this legitimate interest on our part (Article 6 I p. 1 f GDPR). If you have already given the respective operator of the social media platform effective consent to the corresponding data processing, your personal data will also be processed on the basis of this consent (Art. 6 I S. 1 a GDPR).

 

6. Google Analytics Use of Google Analytics

We use Google Analytics to analyze website usage. We use the data obtained from this to optimize our website for you. Google Analytics is a web analytics service operated and provided by Google Inc. (1600 Amphitheater Parkway, Mountain View, CA 94043, United States). Google processes the website usage data on our behalf and contractually undertakes to take measures to ensure the confidentiality of the processed data. During your visit to the website, the following data is recorded, among other things: Pages accessed Your behavior on the pages (e.g. clicks, scrolling behavior and length of stay) Your approximate location (country and city) Your IP address (in anonymous form, so that no clear assignment is possible). is) Technical information such as browser, internet provider, end device and screen resolution Source of your visit (ie via which website or via which advertising medium you came to us) This data is transmitted to a Google server in the USA. In doing so, Google observes the data protection provisions of the US Safe Harbor Agreement. Google Analytics stores cookies in your web browser for a period of two years since your last visit. These cookies contain a randomly generated user ID with which you can be recognized on future website visits. The recorded data is stored together with the randomly generated user ID, which enables the evaluation of pseudonymous user profiles. This user-related data is automatically deleted after 26 months. Other data is stored in aggregate form indefinitely.

7. Videos and Photos

​

Photos and films are taken during my tours, courses and camps. These serve both for video analysis and as a reminder for the participants. We assume that the people who voluntarily allow themselves to be photographed and filmed agree to publication. Some of the most beautiful pictures and films are also published on velochicks.at or on my website as well as on all social media channels of velochicks.at and me. We ask you to let us know if this is not desired.
